1. Introduction
Welcome
to Logical City Clothing Ltd. These Terms and Conditions ("Terms")
govern your use of our website, our tailoring services, and the purchase
of our products. By placing an order, booking a consultation, or
purchasing an item, you agree to be bound by these Terms.
2. Definitions
"Bespoke/Custom": Garments made specifically to the client’s measurements and specifications.
"Ready-to-Wear": Standard-sized garments available for immediate purchase.
"Client": The individual or entity purchasing goods or services.
"The Company": Logical City Clothing Ltd.
3. Orders and Quotes
3.1. Acceptance: All orders are subject to acceptance by Logical City Clothing Ltd. We reserve the right to decline any order at our discretion.
3.2. Quotes: Price estimates given during initial consultations are valid for 30 days. The final price may vary based on fabric choice, design complexity, or changes requested after the work has commenced.
3.3. Consultations:
Initial design consultations are generally complimentary. However,
extensive design sessions or sketches may attract a consultation fee,
which is deductible from the final order cost.
4. Payments
4.1. Deposit: For Bespoke/Custom orders, a non-refundable deposit of [e.g., 50% or 70%] is required before work commences (including fabric cutting).
4.2. Balance: The remaining balance must be cleared before the final delivery or collection of the garment.
4.3. Methods:
We accept cash, M-Pesa, and bank transfers. Cheques are not accepted
unless prior arrangements are made and cleared before delivery.
4.4. Ready-to-Wear: Full payment is required at the time of purchase for all off-the-rack items.
5. Measurements and Fittings (Bespoke Orders)
5.1. Client Measurements:
If the Client is measured by our staff, we guarantee the fit based on those measurements.
If the Client provides their own measurements (e.g., for online orders), Logical City Clothing Ltd is not liable for ill-fitting garments resulting from inaccurate data provided by the Client.
5.2. Body Weight Fluctuations:
We are not responsible for fit issues caused by significant weight
gain, weight loss, or pregnancy occurring between the time of
measurement and the final fitting.
5.3. Fittings: Clients are required to attend scheduled fittings. Failure to attend fittings may result in production delays.
5.4. Final Approval:
Acceptance of the garment at the final fitting or upon delivery
constitutes confirmation that the Client is satisfied with the fit and
design.
6. Alterations Policy
6.1. Included Alterations: For Bespoke orders, minor adjustments required at the time of the final fitting are included in the price.
6.2. Chargeable Alterations:
Major design changes requested after the fabric has been cut.
Alterations requested more than 7 days after collection/delivery.
Alterations required due to weight fluctuation (as per clause 5.2).
6.3. Ready-to-Wear: Alterations on Ready-to-Wear items are charged separately.
7. Fabrics and Materials
7.1. Client-Supplied Fabric: If a Client provides their own fabric:
We will inspect it for suitability but cannot guarantee its quality, durability, or colorfastness.
We
are not liable for flaws in the fabric or how the fabric behaves during
the construction process (e.g., shrinkage), provided we have exercised
reasonable professional care.
7.2. Company Fabric:
While we strive to display fabric colors accurately, actual colors may
vary slightly due to screen settings or dye lot variations.
8. Delivery and Collection
8.1. Timelines:
Estimated completion dates are provided in good faith. While we strive
to meet deadlines, delays caused by fabric shortages, power outages, or
"Force Majeure" events are sometimes unavoidable.
8.2. Shipping:
For orders requiring delivery, risk passes to the Client once the
package is handed over to the courier (e.g., Wells Fargo, G4S, Boda
Boda). We are not liable for delays or damage caused by third-party
couriers.
8.3. Uncollected Goods: Items not collected or paid for within three (3) months
of the completion notification will be disposed of or sold to recover
costs, in accordance with the Disposal of Uncollected Goods Act (Cap 38)
of Kenya.
9. Cancellations and Refunds
9.1. Bespoke/Custom Orders:
Because these items are made to your specific measurements, no refunds or exchanges are allowed once the fabric has been cut.
If a cancellation is made before fabric cutting, the deposit may be refunded less an administrative fee.
9.2. Ready-to-Wear:
Items may be exchanged within 7 days of purchase, provided they are unworn, unwashed, and in original condition with tags attached.
No cash refunds are issued; store credit or exchange only.
10. Intellectual Property
10.1. Any designs, sketches, or patterns created by Logical City Clothing Ltd remain our intellectual property.
10.2.
We reserve the right to photograph completed garments for marketing and
portfolio purposes, unless the Client explicitly requests privacy in
writing.
11. Limitation of Liability
To
the fullest extent permitted by Kenyan law, Logical City Clothing Ltd
shall not be liable for any indirect, incidental, or consequential
damages arising from the use of our services. Our total liability is
limited to the purchase price of the specific order in question.
12. Governing Law and Dispute Resolution
12.1. These Terms are governed by the laws of Kenya.
12.2.
In the event of a dispute, both parties agree to attempt amicable
negotiation first. If this fails, the dispute shall be referred to
arbitration or the courts of Kenya.
